βš–οΈ Elon Musk Just Took the Stand Against OpenAI and It Got Intense Immediately

The trial between Musk and OpenAI kicked off this week in Oakland with Musk testifying first, painting himself as the man who tried to save humanity and got betrayed for it.

The Decode:

What Musk Is Claiming - Musk says he cofounded OpenAI as a nonprofit, gave $44 million in early funding, and claims Altman and Brockman betrayed the original mission. "It was specifically meant to be a charity that does not benefit any individual person."

The Charity Argument - Musk told the jury that "if a verdict comes out that it's OK to loot a charity, the entire foundation of charitable giving in America will be damaged." He called the nonprofit structure non-negotiable from day one.

What He Wants -  Musk is seeking $130 billion in damages, removal of Altman and Brockman, and a forced unwind of OpenAI's for-profit conversion. A win would directly threaten OpenAI's planned IPO.

OpenAI's Response - OpenAI's legal team called the suit "sour grapes," saying Musk only objected to the company's structure after it succeeded without him. "We're here because Mr. Musk didn't get his way at OpenAI."

Microsoft's Defense - Microsoft said it knew nothing of Altman's 2023 firing and that Musk raised no objections to OpenAI's structure until xAI became a direct competitor.

The Drama Outside Court - Judge Rogers scolded Musk for posting about the trial on X and threatened a gag order. OpenAI exists, Musk said from the stand, because Larry Page called him a speciesist. The trial has barely started.
