A federal judge just gave AI companies the green light to train on copyrighted books, if they’re legally obtained. In the Anthropic case, the court ruled that while using books for training is fair use, pirating those books first definitely isn’t. The ruling splits AI legality into two clear issues: how you get the data and what your AI outputs.

The Decode:
1. Training is protected, but sourcing matters - The judge ruled that teaching AI with copyrighted books is legally “transformative,” just like a human reading to learn. But that only holds if the outputs aren’t direct copies. Anthropic passed that test, barely.
2. Library Genesis was the smoking gun - Anthropic sourced training data from sites like Library Genesis, known for pirated books. The court called this out as straight-up theft, and there’s no “AI exception” to copyright law. Now they face a massive damages trial, potentially in the billions.
3. It spells trouble for the whole AI industry - Image generators like MidJourney (under fire from Disney and Universal) look far less protected. OpenAI is also in hot water, with The New York Times claiming ChatGPT regurgitates articles verbatim. The next court date? June 26th.
This ruling sets a clear precedent: training = legal, stealing = not. Any AI model built on pirated data could be forced to pay up, restructure, or shut down. Startups will need deep pockets, or clean data pipelines, to survive what’s coming.
